Terms and Conditions
Last updated: 11 September 2026
1. About these Terms
These Website Terms and Conditions govern your use of the Butterworth Sales and Lettings website at https://butterworth-lettings.co.uk, including any information, forms, referrals or enquiries submitted through it.
These Terms are separate from, and do not replace:
- any landlord Terms of Business;
- any letting, property-management or sales agency agreement;
- any valuation or appraisal terms;
- any property-specific contract;
- any agreement with a buyer, seller, landlord or tenant; or
- any separate terms applying to third-party services.
Using this website or submitting a referral does not appoint Butterworth Sales and Lettings as your estate agent, letting agent or property manager and does not create an agency, management or sales contract.
Any property instruction or service appointment will only arise under separate written terms agreed with the relevant customer.

3. Website use
You may use this website for lawful personal and business purposes connected with property sales, lettings, property management and related services.
You must not:
- use the website for any unlawful or fraudulent purpose;
- submit information that is knowingly false, misleading or incomplete;
- interfere with the website, its security or its operation;
- introduce malware, viruses or other harmful code;
- attempt to gain unauthorised access to any account, system or data;
- copy, scrape, reproduce or commercially exploit website content without permission;
- use property information to harass, contact or disturb occupants;
- impersonate another person or business; or
- use the website to send spam, unsolicited advertising or irrelevant material.
We may suspend or restrict access to the website where reasonably necessary to protect the website, our business, users or third parties.
4. Website information
We aim to keep the website accurate and up to date. However, website information is provided for general information only and may change without notice.
Property details, photographs, floorplans, measurements, descriptions, availability, prices, rents and other particulars may be subject to change and may contain errors or omissions.
Property information should not be relied upon as a substitute for:
- an inspection;
- a professional survey;
- a valuation;
- legal advice;
- tax advice;
- financial or mortgage advice;
- planning advice;
- building-regulations advice; or
- independent verification of the property and its title.
You should carry out your own checks and obtain appropriate professional advice before making any financial or property-related decision.
A property being displayed on the website does not guarantee that:
- it remains available;
- the information is complete;
- a viewing will be available;
- an offer will be accepted;
- a tenancy will be granted;
- a sale will proceed; or
- any transaction will complete.
All sales, lettings and property-management services are subject to separate written terms and any required approval from the relevant landlord, seller, buyer, tenant or other party.
5. Valuations and appraisals
Any valuation, market appraisal or rental estimate provided through or following use of the website is an estimate based on the information available at the time and, where applicable, a visual inspection.
It is not:
- a formal RICS valuation;
- a structural or building survey;
- a mortgage valuation;
- a legal or tax valuation;
- a guarantee of the price achieved on sale;
- a guarantee of the rent achieved; or
- a guarantee that a property will sell or let.
The eventual sale price or rent may differ because of market conditions, property condition, buyer or tenant demand, timing, marketing, negotiation and other factors.
Requesting a valuation or appraisal does not appoint Butterworth as your agent and does not create an obligation to instruct us. Any instruction will be governed by separate written Terms of Business.
6. No professional advice
Unless expressly stated in separate written terms, the website and its content do not provide:
- legal advice;
- financial advice;
- mortgage advice;
- tax advice;
- investment advice;
- insurance advice;
- surveying advice;
- planning advice; or
- construction or building-regulations advice.
You should obtain advice from an appropriately qualified professional before acting on information that may affect your legal, financial, tax or investment position.
Butterworth does not recommend or guarantee any third-party adviser, contractor, broker, insurer, surveyor, solicitor or other service provider merely because a link, referral or reference appears on the website.
7. Intellectual property
Unless stated otherwise, the website and its contents are owned by or licensed to Butterworth.
This includes, where applicable:
- text;
- photographs;
- graphics;
- logos;
- branding;
- layouts;
- videos;
- documents;
- software;
- databases; and
- other website materials.
You may view and print reasonable extracts for your own lawful, non-commercial use.
You must not reproduce, adapt, distribute, republish, sell, licence, modify or commercially exploit website content without our prior written permission.
Property photographs, descriptions and other marketing materials may also belong to landlords, sellers, photographers, portals or other third parties. Separate permission may be required.
8. External links and third-party services
The website may contain links to third-party websites, services, advisers, contractors or platforms.
Those links are provided for convenience. We do not control and are not responsible for:
- the content of third-party websites;
- their availability;
- their security;
- their privacy practices;
- their fees;
- their advice;
- their services; or
- any contract formed between you and a third party.
You should review the relevant third party's terms, privacy notice and regulatory status before using its services.
If we refer you to a third party, any referral fee or other financial interest will be disclosed where required.
9. Contact forms and information submitted by you
When using a contact form or submitting an enquiry, you must provide information that is accurate and not misleading.
You confirm that:
- you are entitled to provide the information submitted;
- the information does not infringe another person's rights;
- you have permission to provide another person's contact details; and
- the information does not contain unlawful, offensive or harmful material.
Submitting an enquiry does not guarantee a response, valuation, viewing, offer, instruction or transaction.
We may use the information provided to respond to your enquiry, provide requested services, administer referrals and comply with our legal and regulatory obligations.
Personal data will be handled in accordance with our Privacy Notice, available at https://butterworth-lettings.co.uk/privacy-policy-2/.
Cookie use is explained in our Cookie Notice, available at https://butterworth-lettings.co.uk/privacy-policy-2/.
You must not provide sensitive personal information unless it is reasonably necessary and requested by us.
10. Refer a Friend scheme
10.1 The scheme
Under the Refer a Friend scheme, Butterworth may pay a promotional reward of £100 to a person who makes a valid referral that results in a qualifying service or sale.
The reward is a promotional payment. It is not:
- a fee payable under a landlord's Terms of Business;
- a commission giving the referrer continuing rights;
- a share of Butterworth's agency fee;
- payment for providing estate agency services; or
- payment for legal, financial or mortgage advice.
The scheme does not create an agency, employment, partnership, franchise or other representative relationship between Butterworth and the referrer.
10.2 Management or let-only referrals
Butterworth will pay £100 to the person who refers a landlord where that landlord subsequently:
- enters into a written agreement with Butterworth for our full management service or a let-only service; and
- takes up that service, with the relevant agreement signed and the first rent or relevant fee received by Butterworth.
The reward is payable per landlord, not per property. If the referred landlord owns or lets several properties, only one £100 reward is payable for that landlord, even if the landlord instructs Butterworth in respect of multiple properties.
The landlord must enter the relevant service within six months of the referral being validly recorded, unless Butterworth confirms a different period in writing.
10.3 Sales referrals
For a valid referral relating to a property to be sold, Butterworth will pay £100 when:
- the sale completes; and
- Butterworth has received the sales fee or other agreed remuneration due in connection with that completed sale.
The sale must result from the referral and must not already have been arranged, instructed or actively progressed with Butterworth when the referral was made.
The relevant sale must complete within six months of the referral being validly recorded, unless Butterworth confirms a different period in writing.
Unless Butterworth confirms otherwise in writing, no reward is payable where the same landlord, seller or property is referred more than once.
10.4 Requirements for a valid referral
A referral must:
- be submitted before the landlord, seller or property is already known to Butterworth or in active contact with Butterworth;
- identify the referrer;
- identify the referred landlord or seller;
- identify the relevant property, if applicable;
- provide accurate contact information;
- be submitted through the method specified by Butterworth;
- be made with the referred person's permission to share their contact details; and
- be capable of being verified by Butterworth.
A referral is not valid merely because a person's name or contact details are sent to Butterworth. The referral must lead to a qualifying service or completed sale within the relevant period.
The referrer must not make promises or representations on Butterworth's behalf about:
- fees;
- valuations;
- rental income;
- sales prices;
- mortgage availability;
- legal rights;
- guaranteed outcomes; or
- the services that Butterworth will provide.
10.5 Excluded referrals
The following are not eligible unless Butterworth expressly agrees otherwise in writing:
- self-referrals;
- referrals made by employees, contractors or agents of Butterworth;
- referrals made by a person who is already receiving payment or commission under a separate agreement with Butterworth;
- duplicate referrals;
- referrals where the landlord, seller or property is already known to Butterworth;
- referrals where Butterworth is already in active contact with the landlord, seller or another representative;
- referrals relating to an existing client, instruction or transaction;
- referrals submitted without permission to share contact details;
- referrals generated by spam, automated messaging or unlawful marketing;
- fraudulent, misleading or fabricated referrals;
- referrals involving a conflict of interest that has not been disclosed;
- referrals made in breach of another person's confidentiality obligations; and
- referrals that would cause Butterworth or the referrer to breach any law, regulation or professional obligation.
10.6 Multiple referrers
If more than one person refers the same landlord, seller or property, the first valid referral recorded by Butterworth will normally be treated as the qualifying referral.
Butterworth's records will be conclusive unless there is clear evidence of an administrative error.
We will not divide or duplicate a £100 reward between multiple referrers unless we agree otherwise in writing.
10.7 When payment is made
A qualifying reward will be paid by bank transfer within 30 days after the relevant qualifying event, provided that:
- the transaction has not been cancelled, refunded or reversed;
- the landlord or seller has not withdrawn before the qualifying event;
- Butterworth has received the relevant fee or remuneration;
- the referral has been verified;
- the referrer has supplied accurate payment details; and
- no legal or compliance issue prevents payment.
The referrer must provide:
- full name;
- address, where reasonably required;
- email address or telephone number;
- bank account name;
- sort code; and
- account number.
No cash alternative is available.
The referrer is responsible for ensuring that payment details are correct. Butterworth is not responsible for a payment sent to incorrect details supplied by the referrer.
The referrer is responsible for obtaining their own tax advice and dealing with any tax, reporting or other obligations arising from the payment.
10.8 No guarantee of instruction or acceptance
Butterworth is not required to:
- accept a referral;
- contact a referred person;
- accept a landlord or seller as a client;
- accept an instruction;
- accept a property;
- provide a valuation;
- provide a letting or management service; or
- proceed with a sale.
Any instruction remains subject to Butterworth's assessment, availability, compliance requirements, service standards and separate written agreement.
10.9 Verification and refusal
We may investigate and verify any referral.
We may refuse, cancel or withhold a reward where we reasonably believe that:
- the referral is invalid;
- the referral was made after the person or property was already known to us;
- the referrer did not have permission to share the information;
- the referral is fraudulent, misleading, unlawful, spam or abusive;
- the referrer has breached these Terms;
- the transaction has not genuinely completed;
- payment would create a legal, regulatory or professional conflict; or
- the payment would be prohibited by another agreement or obligation.
If a reward has been paid and is later found to have been obtained improperly, Butterworth may seek repayment of the reward.
10.10 Data protection and referral consent
A referrer must not send us another person's personal data unless they have a lawful basis and permission to do so.
The preferred method is to ask the potential landlord or seller to contact Butterworth directly or to agree that their details may be passed to us.
Where contact details are shared, the referrer should explain that:
- Butterworth may contact the person about the proposed property service;
- the person's details will be processed in accordance with Butterworth's Privacy Notice;
- the referral does not require the person to instruct Butterworth; and
- the person may ask Butterworth not to contact them further.
We will only use and share personal data in accordance with applicable data-protection law and our Privacy Notice.
The referral reward does not entitle the referrer to receive confidential information about the referred person, their property, their finances, their instruction or any transaction.
10.11 Disclosing the reward
The existence of the £100 promotional reward may be disclosed to a referred landlord, seller or other relevant person where appropriate.
The referral reward does not affect the customer's right to choose another estate agent or service provider.
A referrer must not suggest that Butterworth has endorsed them personally or that they are authorised to act for Butterworth.
If a referrer promotes the scheme publicly, including on social media, they must clearly disclose that a financial reward may be payable to them if the referral qualifies.
10.12 Scheme dates and changes
The scheme starts on 11 September 2026 and will continue until withdrawn.
Butterworth may change, suspend or withdraw the scheme prospectively by publishing updated Terms or otherwise giving reasonable notice.
Any change will not normally affect a referral that:
- was validly recorded before the change;
- met the applicable eligibility requirements; and
- had not expired at the time of the change.
We will not use a change to remove a reward that has already become payable, subject to verification and the other requirements in these Terms.
10.13 Rent Guarantee Included: September, October and November 2026
From 1 September to 30 November 2026, landlords who instruct us on our fully managed service will have Rent Guarantee cover included at no additional cost, within our standard management fee of 9.6% including VAT. The offer applies to new instructions received within those dates and is subject to the property referencing satisfactorily and the insurer accepting the tenancy on its standard terms. Cover is provided by a third-party underwriter and not by Butterworth Sales and Lettings, and any payment of rent or legal costs is made in accordance with the policy terms, limits and exclusions once a valid claim is made. Landlords must hold all current compliance certificates (gas safety, electrical, EPC and any required licence) before the tenancy begins. The offer is subject to availability, may be withdrawn or amended at any time before an instruction is accepted, cannot be combined with any other offer or discount, and is not available on a let-only or rent-collection-only basis. These terms are additional to, and do not replace, our standard Terms of Business.
11. Availability and suspension
We do not guarantee that the website will always be available, uninterrupted, secure or error-free.
The website may be unavailable because of:
- maintenance;
- upgrades;
- technical faults;
- hosting or connectivity problems;
- cyber incidents;
- third-party failures; or
- circumstances outside our reasonable control.
We may suspend, withdraw, change or remove any part of the website without notice where reasonably necessary.
12. Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; or
- any statutory consumer right or remedy that cannot lawfully be excluded.
Subject to that limitation, website information is provided for general information and we will not be responsible for loss arising solely because you relied on information that was clearly presented as general information and which you should independently verify.
We are not responsible for loss caused by:
- your failure to provide accurate information;
- your failure to obtain appropriate professional advice;
- your use of a third-party website or service;
- a third party's acts or omissions;
- an interruption or unavailability of the website;
- unauthorised access outside our reasonable control; or
- a transaction that does not proceed.
Nothing in these Terms changes the basis on which a separate sales, lettings or management service is provided. Any liability arising from a separate service will be governed by the relevant written agreement.
If you are a consumer, nothing in these Terms affects your statutory rights.
13. Changes to these Terms
We may update these Terms from time to time to reflect:
- changes to the website;
- changes to our services;
- changes to law or regulation;
- changes to the Refer a Friend scheme; or
- improvements to clarity or administration.
The current version will be published on this page with the latest update date.
Changes will apply prospectively unless the law requires otherwise. A change will not remove rights that have already accrued under a separate written agreement or a validly accepted referral.
14. Complaints
If you have a complaint about the website, a referral or the operation of the Refer a Friend scheme, please contact:
- Email: team@butterworth-sales-lettings.co.uk
- Telephone: 01803 262772
- Address: Suite 62, 15 Montpellier Road, Torquay, TQ1 1PL
Please provide enough information for us to identify the issue, including any referral reference, relevant dates and supporting evidence.
A complaint about a separate sale, letting or property-management service may be subject to the complaints procedure in the relevant Terms of Business.
15. Governing law and jurisdiction
These Terms and any dispute or claim arising from them are governed by the law of England and Wales.
The courts of England and Wales will have jurisdiction, except that a consumer living in another part of the United Kingdom may have the right to bring proceedings in their home jurisdiction.
16. Severance
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be treated as modified or removed only to the extent necessary.
The remaining provisions will continue in full force and effect.
17. Entire agreement
These Terms constitute the agreement between you and Butterworth in relation to your use of the website and participation in the Refer a Friend scheme.
They do not replace or amend any separate written agreement unless that agreement expressly says so.
